TERMS AND CONDITIONS

Welcome! To ensure an effective working relationship, please read this information carefully and keep it for reference. Please sign and date the agreement above to indicate that you understand these terms and conditions and agree to abide by them.

Please let me know if you have any concerns or questions about this agreement. We can discuss and modify the agreement if needed and agreed by both of us.

DURATION OF THIS AGREEMENT

Change takes time and commitment. Our initial agreement will be valid commencing 2023. Towards the end of our package we will have an opportunity to discuss if we would like to work together for longer and a new Agreement can be drawn up accordingly.

 COACHING PROGRAMME INCLUDES:

Total Price: £4999 (10 part payment plan at £499 per month) 

WHERE

All sessions will take place via Zoom unless otherwise stated or agreed and an email link to the Zoom Room will be sent out ahead of class.

If, for any reason, you are unable to access Zoom we are also able to have all elements of the package via Skype.

As a last resort on occasions of poor wifi and internet connectivity we are able to have some elements of the package conducted via telephone call (the Feminine Power Transformational Coaching sessions only).

 

SESSION TIMES

Sessions will be at a mutually agreeable time. We will work around scheduling conflicts as necessary.  I will make all reasonable efforts to accommodate your scheduling needs.

If we are having a phone or Skype session, it will be your responsibility to call me at the agreed upon time.

SCHEDULING SESSIONS

You acknowledge that the Coaching Sessions and Hypnotherapy / Rapid Transformational Therapy sessions may be personally, emotionally and physically challenging and that there may be occasions on which you feel emotional challenges – including frustration, annoyance or stress. Please make all efforts to schedule all sessions at such times to ensure peak physical, mental and emotional state and condition necessary for the conduct of the session and shall (if necessary) take steps to cancel any session in the event that you are not well enough to continue.

You will not hold me liable for any loss or cost incurred by you (or any person related to you) in the event of mental, physical, emotional stress or distress (or other ailment or condition) caused either directly or indirectly in relation to the coaching sessions. You shall indemnify me in the event of any such claim.

PREPARATION FOR SESSIONS

Please take some time before each session to review your progress, your written actions, and what you’d like to get out of your coaching session and submit your weekly coaching form a minimum of 24 hours ahead of your next session.

CONTACT BETWEEN SESSIONS

If you feel stuck or challenged between sessions, please do not struggle alone.  I am available by phone and email to support you within business hours. There is no charge for short calls or written correspondence equaling up to 30mins of my time a week. There is an extra fee for calls 15 minutes and over in length, equaling 25% of your session fee for every 15 minutes spent speaking.

My office hours are 10:00am to 18:30pm Monday to Friday and I will respond to all emails and voicemail messages within two business days unless I notify you that I will be unavailable for a longer period of time.

REFUND POLICY

I do not offer a refund on coaching packages. I am here to coach you to your highest level of success and part of that is requiring a commitment from you that you are fully invested in your coaching package. 

Should you need to reschedule a coaching session, you may do so by providing 48 hours notice in advance of your session and making up the session within a week of the originally scheduled date.  Sessions not cancelled 48 hours in advance will not be eligible for a rescheduled session.  

I also understand that emergencies do happen and will make an exception if

you feel suddenly physically unwell and emotionally and mentally unable to attend the session. However please do give me as much notice as possible.

CANCELLATION AND TERMINATION

You may end this Agreement by providing me with 14 days notice. Please

remember that no refunds apply and you will be liable for full payment of the Fee

despite any notice of cancellation.

I shall be entitled to limit the Services or suspend, and/or terminate this

Agreement with immediate effect and without refund of any Fee, whether paid or

remaining due and payable, if I reasonably determine that you have:

1) committed a material breach of any of your obligations under this

Agreement; or

2) failed to provide payment of any sum due to us as and when it becomes

due; or

3) become subject to a bankruptcy or similar financial order or proceedings;

or

4) acted or behaved dishonestly, fraudulently, or in a way which we

reasonably consider may have a detrimental effect on our business or reputation;

or

5)  failed to positively engage with the Services or impaired the delivery of

the Services to you or a Programme Participant; or

6) acted in a way which is abusive or is intended to cause offence to us or a

Programme Participant; and/or

7) failed to abide by any term of this Agreement or any other guidance we

may provide whether such action constitutes a material breach or not.

Upon termination of this Agreement for any reason:

Your access to all Services, any private social media accounts, any Groups,

and any other online resources, will be removed, unless expressly agreed otherwise.

LATE FOR A SESSION

It is in your interest to arrive on time so that you can have a full session. The appointment begins at the time it is booked for, regardless of the time you arrive. Punctuality supports the structure, content and value of a session.

NON PAYMENT OF FEES

Fees are to be paid in advance, at the start of the coaching package or as per your agreed payment plan. Late fees will apply. For each week, the payment is late, please add an additional 10% to the total fee due for the coaching session. Payment of fees is required regardless of your availability. Where your account is beyond 7 days overdue then I shall be entitled to withhold delivery of Services until payment has been made in respect of the outstanding amount.

The Fee is based upon our knowledge and experience and the time, effort and

availability of the Services and is not based on your actual usage and/or level of

attendance. I reserve the right to change the Fee at any time. Any changes will not affect the price of Services where payment has already been made and you have received a welcome email.

CONCERNS

If anything occurs between us at any time that concerns you or doesn't feel right, please inform me. My goal is to have an open, authentic, trusting partnership with you. It is your responsibility to let me know of anything that you feel isn’t working or could be working better so that we can adjust accordingly.

THE COACHING METHODS

This Coaching Program is offered as a powerful tool to support you to have a breakthrough in one or more areas of your life.  The program is highly transformative in nature and will help you to understand yourself as source of your experience, to identify and break up old patterns that have been the glass ceiling upon your potentials, and to rigorously take on the cultivation of new ways of being and new skills and capacities that will enhance your opportunities for realizing your potentials making your greatest contributions. Our coaching conversations are oriented around the future you are committed to creating for yourself and others. Together, we work as partners to discover your specific obstacles to the realization of your potentials, identify ways to release them, become clear about the future you are committed to creating, and the ways of being you will need to cultivate in order to do so.

FEMININE POWER COACHING

Feminine Power Coaching does not treat severe emotional distress such as serious depression, anxiety or trauma recovery.  If you are experiencing any of these issues, I encourage you to have in place additional support such as a psychotherapist.  If you are already in treatment for a psychological problem, I ask that you inform your therapist that you are participating in this coaching package.

 

This package has been designed to provide you with information, materials and skills to support you in developing your business, it is not a substitute for counselling or other therapy services and I am not a medical or health practitioner.

If you are currently seeking medical or other professional help concerning your mental health, or if you are unsure as to your mental capacity to use this service or if you require information or assistance concerning any medical or health related issue then you should seek the advice of your qualified medical practitioner and inform me if appropriate and relevant.

ACCESS AND USE OF ADVANCED HYPNOTHERAPY,

I (Dominique Didinal) am a certified hypnotherapist and insured to perform hypnotherapy. ALL modalities included in the Agreement (HEARTHEALING ™ RAPID TRANSFORMATIONAL THERAPY ™ HYPNOTHERAPY, energy healing and meditation) are not psychotherapy, and I am not a licensed psychotherapist.  I am neither a  trained medical health provider or medical health practitioner. I do not offer the services or treatment of a licensed physician, psychologist or psychiatrist. I am not licensed to practice psychology, and I do not claim to offer any psychological benefits, or psychometrist (or any form of psychometrics) or psychometry services. The Services provided by Radiant Woman are non-diagnostic and are not licensed by the state.

You should consult the advice of your physician or other professional medical practitioner before considering the services outlined in this Agreement. Pursuant to UK Business & Professions Code, the Services, the techniques, hypnotic or otherwise, serve strictly as avocational or vocational self-improvement are not to be construed as and Dominique Didinal is not and will not provide medical or mental health therapy for emotional or mental disorders.

During your use of the package you may be exposed to information or situations that trigger deep or otherwise unresolved emotional responses. By using and participating in this Agreement you are confirming that you are mentally well enough to do so and that you understand that you are personally responsible for managing your own emotional state. You agree not to hold me liable for any emotional distress experienced as a result of your use of the Services and I reserve the right to terminate your access to the Services where I have concerns as to your suitability to safely use the Services.

As part of your participation in the programme and access to the Services, you

may be required to review and make decisions concerning your personal and home life, business and career, finances, lifestyle, education and development and health and wellness. You accept that any such reviews, subsequent decisions, implementation and action will be your sole responsibility and that we shall not be liable for your failure to make decisions, put into action plans or strategy, or for any results whether direct or indirect arising out of your access to and/or use of the Services.

You will remain at all times fully responsible for your own health and well-being. You agree that should you have any concerns concerning your health, diet, medication or any medical conditions that you will seek the advice of your qualified medical practitioner.

NO WARRANTIES GIVEN.

Participating in the Agreement does not guarantee success and I make no representation, guarantee, or warranty that the coaching sessions that you are contracting for will work for you in your particular circumstances.  You agree to hold me harmless and indemnify me for any damages incurred by you directly or indirectly as a result of coaching. All information on the website www.radiant-woman.org or included in statements, testimonials or materials made or distributed by or on behalf of Radiant Woman and Dominique Didinal are for informational purposes only, and are not intended to be relied on by Client or to constitute a representation of the effects or benefits of the Services.

CONFIDENTIALITY

I want to create a safe and secure space for everyone accessing this Service and therefore the protection of confidentiality is very important to me.

When you disclose Confidential Information to us, we agree not to communicate or disclose it, make it available to others, or use it for our own purposes without your consent or as provided for in this Agreement.

Where we disclose Confidential Information to you, or where it is disclosed by a Programme Participant, you agree that the Confidential Information belongs solely and exclusively to the person disclosing it, and that you will not:Disclose, communicate, reproduce or distribute it, or use it for your own benefit, whether personally or commercially, and whether directly or indirectly; use it for any purposes which are unlawful, would cause harm or distress to another person, or would cause damage to our business or reputation.

 

INTELLECTUAL PROPERTY

As part of the Services I may provide you with materials, information, tools, videos, resources, data and other content (“Content”). I may also provide you with access to my unique therapeutic and coaching methods and tools including the Radiant Power System (“Systems”) and Radiant Woman. I take the protection of my Intellectual Property Rights in relation to our Content, Systems and Services very seriously. You agree and accept that all Content and Systems remains my confidential and proprietary intellectual property and belong solely and exclusively to Dominique Didinal,

My Content and Systems can only be used by you in connection with your use of the Services AND when you purchase my Services you agree and undertake that from the date of this Agreement that you SHALL NOT (save as provided for in this Agreement): Copy, reproduce, sell, license, share or distribute any of my Content or Systems, whether during the period of provision of the Services, or at any time thereafter; record any webinars, online or in-person events, videos, Sessions or any Content or Systems; infringe any of my copyrights, patents, trademarks, trade secrets or other intellectual property rights or any such rights belonging to a Programme Participant.

 

In the event of your breach of your obligations relating to my Intellectual

Property (including but not limited to the Content Systems and Services) then:

you shall immediately cease and desist the illegal use of my Intellectual

Property upon receipt of such notice from myself. You agree and accept that damages, loss, or irreparable harm may arise for us due to your illegal use of my Intellectual Property and, in such circumstances, I shall be entitled to seek relief, including injunctive relief against you; and you shall indemnify and keep me fully indemnified for all such damages and losses sustained as a consequence of your breach of this.

The provisions above shall continue in force notwithstanding termination of the Agreement for any reason.

YOUR PERSONAL DATA AND HOW WE USE IT.

Personal data for the purposes of this Agreement means any information which is

capable of identifying another individual, as further defined within the General Data Protection Regulation 2016/679 (“GDPR”). REVIEWS AND TESTIMONIALS

If you share comments, information, content, photographs, graphics or images (“Client Content”) with me you are granting me free of charge, permission to use that Client Content in any way as part of my business service, which shall include advertising and marketing. When sharing Client Content you confirm that you have the legal right to share it and that it doesn’t infringe any third party’s intellectual property or other rights.

 

As part of our agreement you agree to provide or approve a written and video testimonial on successful completion of the package along with permission to reproduce your FB/Whatsapp messages, insights etc that show success. By agreeing to this you also give me permission to use your image (photo of your choosing) name, occupation and country to be used across my marketing material including website.

If using your image and any of the following; name, occupation and country, alongside your testimonial -  I agree to always providing you with a draft of the testimonial for your approval before it is published.

COMPLAINTS

We want you to be entirely happy with the Services. In the event you have any

concerns about the Services, you agree to let us know by email to

[email protected] and give us a reasonable amount of time to investigate and resolve your concerns before you take any further action.

PERMISSION TO INCLUDE DETAILS ON COACHING LOG

I’m committed to gaining the highest level of coaching credential through the International Coaching Federation (ICF) and Feminine Power. In signing this agreement you acknowledge that I can include your name, phone number, email address, and number of coaching hours in my log of coaching for credentialing. This information would be treated in strict confidence and no other information about your coaching would be revealed. You may be contacted by an ICF credentialing and/or Feminine Power representative, for verification that I have coached you.
